Casual employment is now defined by the substance of the relationship, not the label on the contract, and casuals can compel a conversation about going permanent. Drafted for Australian employers engaging genuine casuals under the current rules.

What this document does

A casual contract that matches the reality

Since August 2024 the test for casual employment looks at how the relationship actually operates, not what the paperwork calls it. A casual contract still matters — it records the loading, the shift mechanics and the absence of a firm advance commitment — but it no longer settles the question on its own.

The law that applies

The employee choice pathway

The definition of casual employment in force from 26 August 2024 turns on the real substance of the relationship rather than the contract’s description of it.

A casual may notify the employer that they want to convert to permanent employment after six months — twelve months where the employer is a small business employer. This pathway replaced the older employer-offer and right-to-request routes.

The employer must consult the employee, then respond in writing within 21 days, and may only refuse on the specified grounds.

What goes wrong

Pitfalls we see in practice

Missing the 21-day response window

Once a casual gives notice under the employee choice pathway, the employer must consult the employee and then respond in writing within 21 days, and may refuse only on the specified grounds. The window is short, it runs from the notification rather than from when someone notices the email, and it is an administrative failure with a substantive consequence.

Treating the casual label as determinative

It no longer is. The contract is evidence of the relationship, not the definition of it. An employer relying on the words in the document rather than on how the roster actually operates is relying on a test that was replaced in August 2024 — and the roster, not the contract, is what a claim will be decided on.

Not giving the Casual Employment Information Statement at each required point

The statement is not a one-off induction document. It must be provided at the required intervals, the obligation is trivially easy to satisfy, and it is equally easy to forget once someone has been on the books a while. It is also among the first things checked when a claim is made, because it is a matter of record rather than argument.

Paying loading and assuming it settles the question

Casual loading paid on the footing of casual employment can be offset against certain entitlements if the classification is later found to be wrong. That is a partial remedy after the fact, not a defence to misclassification. It reduces the number at the end; it does not answer the claim.

Questions

Frequently asked

When can a casual employee ask to become permanent?

Under the employee choice pathway, after six months of employment — or twelve months if the employer is a small business employer. The employee initiates it by written notification; the employer does not have to offer first.

Can I refuse a conversion request, and on what grounds?

Yes, but only on the grounds the legislation specifies, and only after consulting the employee. The refusal must be in writing and given within 21 days of the notification, with reasons.

Does paying casual loading protect me if the employee is reclassified?

Partly. Loading paid on the footing of casual employment can be offset against certain entitlements if the classification is later found to be wrong — but that is a remedy after the fact, not a defence to misclassification. Getting the substance right is the protection.
